2023 Vendor Terms and Conditions

Space

  • The deadline to complete and return this contract is November 15, 2023.

  • Upon approval of the vendor application, receipt of a signed contract, and receipt of payment, ABC will grant the Vendor the right to use a designated booth at he Winter Festival.

  • The festival will take place in Uptown Mt. Sterling, Illinois from November 25, 2023 through January 6 on designated dates (and times) in Exhibit A to this Contract (Festival Dates).

  • Final site plan, specific vendor Space assignments, and instructions will be forwarded by ABC via email by November 10, 2023.

  • Vendor’s use of the Space is non-transferable. Vendor may not allow anyone else to use the Space without the express consent of ABC.

  • Vendor is responsible for clean up and maintaining the look of their Space. 

Rules and Regulations

  • A description of goods being sold/vendor activities is required for the application.

  • Vendor must keep their property and merchandise within the boundaries of their assigned vendor Space.

  • Vendor is prohibited from selling counterfeit items, unlicensed merchandise, guns, ammunition, alcohol, drug paraphernalia, items prohibited by Illinois or Federal law, or any merchandise that ABC, at its sole discretion, considers racist, discriminatory, or offensive.

  • Vendors may not sell beverages of any kind without prior approval of ABC, including soda, alcohol, water, or other non-alcoholic beverages. If beverage sales are approved by ABC in vendor booths, those vendors will be the exclusive vendor of those beverages. 

  • Vendors must provide their own change for customer cash transactions. ABC will not provide or arrange for cash change. Please plan accordingly.

  • Vendor must arrive to set up prior to festival operation hours. LOADING IN OR OUT WILL NOT BE ALLOWED DURING FESTIVAL OPERATION HOURS. There is no dedicated parking for Vendor vehicles during festival operation hours or within the vendor area.

  • Vendor is responsible for obtaining and/or paying for any state and/or federal business licenses, permits, and taxes that are required for its operation including state sales tax. 

  • ABC offers no guarantees or warranties of any kind.

  • ABC will not provide a refund due to inclement weather. 

  • Vendor must be set-up and be ready for operation as outlined in Exhibit A.

  • Vendors must remove all products and equipment at the end of the Festival. Vendor must properly discard trash in appropriate trash/recycling receptacles.

  • Vendors must leave Space in the same condition as when provided.

  • Vendor must vacate the festival grounds not later than specified in Exhibit A.

  • ABC is not liable for theft or damage to Vendor equipment and/or inventory.

Causes for Denial or Revocation of Selling Privileges

  • ABC may revoke this contract, canceling Vendor’s right to occupancy of the Space, if ABC believes, at its sole and complete discretion, that the Vendor has violated any of the terms of this contract.

  • ABC reserves the right to deny or refund this application for any reason.

Fees and Payment

  • Festival Vendor Fees:

    • Booth size will be approx. 10’ x 10’ located inside the American Legion.

    • One table and two chairs will be provided.

    • Full payment of fees must accompany submission of this contract and is not refundable. 


Authority

  • The individual executing this Contract on behalf of the Vendor represents and warrants that said individual is duly authorized to execute and deliver this contract on behalf of the Vendor.

My signature certifies that I have read, understand, and agree to comply with the terms of this Contract.

Please make a copy of this contract for your records. Signed contracts will be retained by ABC for two years following the conclusion of the Festival.

EXHIBIT A

Winter Festival Schedule and Vendor Timelines

Fridays: 

  • Set up time 2 PM. 

  • Must be set up and ready by Rink operating hours (3–8 PM).

  • Tear down/clean up from 8–9 PM.

Saturdays:

  • Set up time 10 AM.

  • Must be set up and ready by Rink operating hours (11–8 PM).

  • Tear down/clean up from 8–9 PM.

Sundays:

  • Set up time 11 AM.

  • Must be set up and ready by Rink operating hours (1–6 pm).

  • Tear down/clean up from 6–8 PM.

**Friday December 1st is Winter Festival Kick-off night. Ice rink is open 3 to 9 PM.

  • Tear down/clean up will be from 9–10 PM

**The Rink Holiday Hours of Operation:

Thanksgiving–closed

Christmas Eve–closed

Christmas Day–closed

New Years Eve–1–6 PM

New Years Day–1–6 PM

**The Rink Normal Hours of Operation:

Monday Closed

Tues & Wed Private rentals

Thursday 3–8 PM

Friday 3–8 PM

Saturday 11–8 PM

Sunday 1–6 PM
